Eminent Domain for Development in Glen Falls?

The Glens Falls Industrial Development Agency is exploring the feasibility of using eminent domain to facilitate redevelopment projects selected for the city’s $10 million Downtown Revitalization Initiative.

Some buildings along South and Elm streets, a priority section of downtown under the initiative, carry unrealistic sale prices, considering the condition of the buildings, said Judy Calogero, chairwoman of the IDA board, without mentioning specific properties.

“Some of the property that you want to use may no longer be available at its appraised value,” she said.

The IDA board voted to hire a lawyer to research the legality of the city taking property by eminent domain and whether that is allowable under the state’s rules for the Downtown Revitalization Initiative.

The lawyer will be selected from a list of lawyers the IDA has pre-approved contracts to use on a case-by-case basis.

A local committee, separate from the IDA, is preparing a plan to use the $10 million state grant the city received in August.
