Attorney Fee Recovery Statutes in Washington

If a trial is held to determine just compensation, the court may award attorney recovery fees in the state of Washington if (WA 8.25.070):

• The condemning authority fails to make any written offer to the property owner at least 30 days prior to the commencement of the trial
• The judgment awarded at the trial exceeds the highest written offer by at least 10 percent
• The attorney representing the condemning authority allows the property owner reasonable attorney's fees as part of the settlement in the eminent domain proceeding
• The condemning authority requests, in writing, to take immediate possession and use of the property, then the property owner shall be entitled to an award of reasonable attorney's fees and reasonable expert witness fees.
