Attorney Fee Recovery Statutes in Arizona

If the government abandons a proceeding, or if the court determines that the property may not be acquired, attorney's fees may be recoverable. If the proceeding is dismissed because both parties agree to settle outside of court, then each party shall pay their own costs. (§ 12-1129(B)) Additionally, if the property is an owner-occupied residential property, the court may award attorney recovery fees and other expenses. (§ 12-1130 (D))
